A patent attorney is a person rendering legal services in the field of industrial property. In order to have the right to act as a patent attorney, the candidate shall pass the respective examination and the patent attorney has to meet the requirements set in the Act on Patent Attorneys. The most important of which are higher education, previous work experience in the field the profession is being acquired (at least four last years at a patent attorney’s office or at a business association of patent attorneys) and knowing at least two foreign languages (at least one of which must be English, German or French). The Estonian Act on Patent Attorneys was adopted in 2001. A person who pursuant to the Act on Patent Attorneys has been awarded the vocation of a patent attorney may act as a patent attorney enabling them to practice in the following fields: Within their area of practice, the patent attorneys are competent to:
1) render legal services; 2) represent a person in a state office (including the Patent Office) and in court and on other occasions; 3) gather evidence; 4) freely choose and use means and ways allowed by the law in rendering legal services to individuals; 5) verify translations and copies of documents on industrial property to be presented to institutions.
Patent attorneys may be divided into two groups: Estonian patent attorneys and European patent attorneys. Estonian patent attorneys have the right to represent the interests of their clients at the Estonian Patent Office and at the Office of Harmonization for the Internal Market (OHIM), European patent attorneys have the right to represent the interests of their clients before the European Patent Office as well. Patent attorneys working in our office are both Estonian and European patent attorneys. Additionally we have contracts on co-operation with experts in several universities and scientific institutions as well as with translators. Our patent attorneys and other specialists constantly gain new knowledge in the field of legal protection of industrial property by taking part in seminars and training courses organized in Estonia as well as by participating in training programs arranged by the World Intellectual Property Organization (WIPO), the European Patent Office (EPO) and by the Office of Harmonization for the Internal Market (OHIM). In addition to that they regularly visit specialized international conferences which all ensure the most up-to-date knowledge of our specialists in the field of legal protection of industrial property. |
